On Monday, District Judge Kaydee Snipes Ruiz approved Hill County Attorney Karen Alley’s request to drop the charges against Harmon without prejudice, which allows the charges to be refiled. The case is closed, for the time being.

In Alley’s request to dismiss the charges, she said she will refile the charges after Harmon is released on probation for previous offenses in Hill and Yellowstone counties.

As of Wednesday, Harmon was listed as being held in the Dawson County Correctional Facility.

On Tuesday, his location was listed a “secure facility” in Montana. Carolyn Bright, Montana Department of Corrections communications director, had said at the time she could not provide any more information on Harmon’s exact whereabouts for security reasons.

Harmon, born in 1977, was arrested Sept. 27. He was charged with three counts of felony criminal possession of dangerous drugs and one misdemeanor charge of criminal possession of drug paraphernalia after police allegedly found methamphetamine and pills in his home. Harmon pleaded not guilty to all the charges on Oct. 21.

Following the allegations, Harmon sent a dictated letter to local media outlets in response to the arrest. You can read the letter here.

Jason Holden, a Great Falls attorney, represents Harmon.

Harmon has been a key figure in the family business, Big Equipment Co.

Harmon’s father had told The Havre Herald after his son’s arrest that the charging documents includes some “misleading” information.

Harmon has prior offenses, including criminal possession of dangerous drugs in 2001 and in 2014, a bail jumping offense in 2014, and a theft offense in 2001.

Suspects are considered innocent until they are proven guilty.

Hill County Attorney Karen Alley filed a motion to temporarily dismiss the case against Harmon on Monday.

Update: This story has been updated to include Harmon’s location as of Wednesday.
